Britain set to clear fresh Microsoft-Activision deal

Britain’s antitrust regulator has stated that Microsoft’s $69 billion acquisition of Activision Blizzard has opened the door for the largest gaming deal to be cleared. The deal was initially blocked in April due to concerns about Microsoft’s control over the cloud gaming market. However, in August, Activision agreed to sell its streaming rights to Ubisoft Entertainment in an attempt to address these concerns. The Competition and Markets Authority (CMA) has now stated that the Ubisoft divestment substantially addresses its previous concerns. Microsoft has presented remedies to address any remaining issues, and the CMA is currently consulting on these remedies before making a final decision. The European Union has already approved the deal, while the U.S. Federal Trade Commission opposes it but has been unsuccessful in stopping it. The CMA’s decision to reopen the case after its initial block was seen as a departure from its usual approach, and the regulator has emphasized the importance of parties presenting credible and effective remedies at the right time. Despite the loss of cloud gaming rights, Microsoft is optimistic about earning approval to close the deal before the October 18 deadline. Shares in Activision and Microsoft have risen in response to the preliminary approval, and the CMA’s handling of the case has drawn attention to the way competition regulators deal with “Big Tech.”
