As the world turns so does the life of Bill Cosby. Not only do most of us feel like shenanigans has now played a role in our lives that we truly do understand that saying now for sure that we never know what is behind closed doors. The beloved actor who’s now having this tarnish lifestyle come to light seems to be falling from grace as we speak.
Bill Cosby was charged finally for the first time for the crimes of being a sexual predator. Bail was set at 1 million and he was ordered to surrender his passport. Of course, Cosby is denying the charges against him and now the defense team is in OJ Simpson mode trying to prepare for a hearing of the New Year.
So what does this mean and what can his team of lawyer come up with to try to defend for his preliminary hearing? Also, can the commonwealth prove the case beyond a reasonable doubt, and the real question everyone is now asking what can happen to Cosby?
What we do know at this time is that 50 women have accused Cosby of sexual assaults that date back to the 60’s. Most of the cases have passed the statutory limits on the time frame, except for one and the newly elected Montgomery County district attorney was quick to file charges with the new evidence that has come to light.
Now if the prosecutors are waiting just a few weeks this too would have not been even able to come to the courts light. The 12 year old accusation that Bill Cosby was this sexual predator could have lost her chance and now could have Cosby facing the possibility to be behind bars for maybe a decade. This case that is involved Andrea Constand most likely be the most watched sexual prosecution watched in history.
The Cosby charges are aggravated indecent assault. Aggravated indecent assault is not necessarily actual intercourse, it only requires the minimal penetration of the genitals or anus with the complainant by any parts of the defendant’s body or fingers. Also the commonwealth must and this is a must prove additional facts like such as that the penetration happened while the complaint was unconscious. Or that the defendant impaired the complainant by using intoxication or it simply that there was no consent.
This charge of aggravated indecent assault is a second degree felony. That which has a maximum of 10 years behind bars. Now does this mean that they will always get the 10 years no but it is the maximum.
Also the courts will take in consideration the defendant’s criminal record and also the seriousness of the crime that was done. Then would calculate the suggested punishment for each crime. There is a matrix that is used by the Pennsylvania lawyer that calculate the guideline and gives a range approved by the court.
So with Cosby not having a any priors of a criminal record that will be looked at in the court of law and that is a major factor in calculating the sentences. But even with the calculated formula, it is not binding, it can still be up to the courts in the end. If convicted Cosby could be sentenced between 22-36 months incarcerated. But yet again this must be stated it many not cross the maximum time frame of 10 years. We just will have to wait to see when it comes time to call with the courts and if there will be a negotiation with the prosecution.
