Dzhokhar Tsarnaev, Boston Bomber’s Death Sentence Overturned

The Federal Appeals Court has overturned the death sentence of the 2013 Boston bomber Dzhokhar Tsarnaev who had been convicted in 2015.

The court ruled that the jury at the Boston bomber’s initial trial was not properly screened for bias. The ruling claims that some of the jury during the trial had personal biases when they made the decision.

Three judges from the 1st US Circuit Court of Appeals called for a new sentencing trial in order to decide if the death sentence shall proceed or if Tsarnaev will be sentenced to life in prison.

The sentencing trial could take place in the US Supreme Court or an appeals court.

According to the Federal Appeals Court document, Judge Georg O’ Toole Jr, who headed Tsarnaev’s 2015 trial, did not ensure fairness during jury selection.

Judge O. Rogeriee Thompson, Judge Juan Torruella, and Judge William J. Kayatta Jr. presided over the appeal.

Thompson said that it is the criminal justice system’s core promise that even ”the very worst among us” deserves to be fairly tried and lawfully punished.

According to court documents from the 1st Circuit, the court found that O’Toole did not screen for how much ”prospective the jurors had heard about the case previously. The document noted the influence of great media coverage during the 2015 case.

Thompson said that by not having the jurors identify what it was they already thought they knew about the case, the O’Toole made it ”too difficult for himself and the parties to determine both the nature of any taint.”

Such a ”taint” includes whether the juror knew something prejudicial not to be used at trial.

Tsarnaev in the Boston Bomber

The bombing on April 15, 2013, the Boston Marathon is something the whole America will never forget. Five people were killed by two homemade pressure-cooker bombs positioned at 14 seconds and 210 yards apart near the finish line.

There were hundreds of people that were injured and 17 who lost limbs.

The Federal Bureau of Investigation identified the Boston Bombers as Kyrgyzstani-American brothers Dzhokhar Tsarnaev and Tamerlan Tsarnaev.

During the police hunt, the brothers killed a policeman and kidnapped a man in his car.

Tsarnaev and his brother had a shootout with the police in Watertown. Two officers were injured during the shootout, and Tamerlan was shot several times.

Tsarnaev ran him over while trying to escape the police leaving Tamerlan to die behind.

On April 19, the police issued a manhunt for Tsarnaev. During this time, residents of Watertown and surrounding communities were asked to stay home while transportation and businesses were closed.

On the same day, Tsarnaev was found by a resident hiding in a boat in his backyard.

A shootout happened, and Tsarnaev was wounded by police before he was taken to custody.

Tsarnaev told police that he and his brother were influenced by the ongoing wars in Iraq and Afghanistan.

According to him, they were self-radicalized, and he denied any connection to any terrorist groups.

He admitted that he and his brother are knowledgeable in making bombs and they learned to build explosive devices from an online magazine of Al-Qaeda.

He also admitted that they have a plan to travel to New York City and bomb the NY Times Square.

Tsarnaev was sentenced to death on April 8, 2015.
