Emile Hirsch was charged with assault on Thursday after police reported that the young actor placed Daniele Bernfield, a studio employee in a chokehold.

Hirsch, was in Utah for the Sundance Film Festival and is currently being charged with aggravated assault a charge, which could potentially place the actor in prison for five years. He was also charged with intoxication, which is being classified as a misdemeanor.

Bernfield is currently an employee of Paramount Pictures. She and Hirsch got into an argument on January 25 when the two were at a Tao Nightclub in Park City.

Hirsch reportedly approached Bernfeld and asked why Bernfield looked “so tough,” and continued to call her a “rich kid who should not be at Sundance.”

According to investigators, Bernfeld pushed Hirsch away after the actor grabbed her. Hirsch then left to return to his friends, but it was not long until he returned and continued to grab her. Authorities reported that Hirsch pulled her across the table, and then fell on top of her after they both fell on the floor.

Hirsch who is best known for his performances in, “Into the Wild,” “Lone Survivor,” “The Girl Next Door,” and “Lords of Dogtown,” was in town for the film festival for his current movie, “Ten Thousand Saints.”

The actor has not given an official statement regarding the incident, and his first court date is set for March 16.
