Spanish court throws out Rubiales’ pre-kiss defamation lawsuit

A Spanish court has rejected a lawsuit filed by former president of the Royal Spanish Football Federation, Luis Rubiales, against coach Javier Clemente. In the lawsuit, Clemente had referred to Rubiales as a “dangerous and ambitious guy” who was seeking to enrich himself. The court deemed Clemente’s comments as an exercise of free speech, stating that he was expressing an opinion about a public figure. The ruling, dated September 1, can be appealed.

Rubiales declined to comment on the court’s decision, while Clemente, who served as Spain’s national men’s team coach in the 1990s, was unavailable for comment. Rubiales had filed the lawsuit against Clemente in 2022 after the coach claimed in an interview that Rubiales’ intention was to amass wealth as the head of the RFEF.

The court’s ruling comes amidst a separate scandal involving Rubiales’ behavior at the Women’s World Cup last month. During the medal ceremony following Spain’s victory, Rubiales kissed player Jenni Hermoso on the lips, sparking a controversy regarding sexism in Spanish sport and society. Despite facing calls from players, politicians, and women’s groups to step down, Rubiales resisted until September 10 when he finally resigned as president of the RFEF and as vice president of UEFA. This decision came shortly after Hermoso filed a criminal complaint against him for alleged sexual assault.

Javier Clemente, a former player, achieved success as the coach of Athletic Bilbao, leading them to La Liga titles. He also managed the Spain national team, guiding them to the 1994 and 1998 World Cups. Additionally, Clemente has coached the national teams of Serbia, Cameroon, and Libya.
